Coupled with the influx of
retirees to Clark County has been the growth of nursing homes within
our community to handle the aging population. State and Federal
regulations have been passed to protect the elderly who are so often
unable to protect themselves.
OBRA 87 - Omnibus Reconciliation Act of
1987
OBRA 1987 (the Nursing Home Reform Act) specifies that a
nursing home "must provide services and activities to attain or
maintain the highest practicable physical, mental, and psychosocial
well-being of each resident in accordance with a written plan of care .
. ."
Nursing home cases include
but are not limited to general premises liability, falls, decubitus
ulcers, physical/sexual abuse, wandering off premises, medication
errors, neglect (malnutrition and dehydration) and loss of dignity.
According to an
investigation by the St. Louis Post-Dispatch, a review of government
documents and court records indicates that thousands of elderly
patients in nursing homes are dying from negligent caregivers. (10/15/02)
A study by the California HealthCare Foundation found that more than
three-fourths (3/4) of California nursing homes failed to meet federal
standards. The thirty-two (32) month study also found tremendous
